Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("Customer", "you") and Demografix ApS ("Demografix", "we", "us"), a company registered in Denmark (CVR: DK40697179), with its registered address at Eriksvej 30, 1 th., Roskilde, Sjælland 4000, Denmark.

These Terms govern your access to and use of the APIs and related services operated by Demografix at genderize.io, agify.io, and nationalize.io (collectively, the "Services").

By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

Demografix operates three name-based demographic prediction APIs:

  • Genderize.io — predicts the likely gender associated with a name
  • Agify.io — predicts the likely age associated with a name
  • Nationalize.io — predicts the likely nationality associated with a name

The Services accept names as input via HTTP API requests and return statistical predictions based on aggregated demographic data. A single subscription provides access to all three APIs.

Predictions are statistical estimates, not facts. Results are based on historical and aggregated data and reflect probabilities, not certainties. They should not be used as the sole basis for legal, medical, financial, or employment decisions, or for any purpose that could result in material harm to individuals.

2. Accounts

To access paid features, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials and for all activity under your account.

You agree to provide accurate account information and to keep it current.

3. Subscriptions and Payment

Subscription Tiers

The Services are available through tiered subscription plans as described on our pricing page. Each tier specifies a monthly name lookup limit. A free tier is available with limited daily usage.

Billing

Subscriptions are billed monthly or yearly, depending on the plan selected. All prices are in US dollars (USD). Applicable taxes are calculated and collected via Stripe Tax.

Subscriptions renew automatically at the end of each billing period. You authorize Demografix to charge your payment method on file for each renewal.

Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. You retain access to the Services until that date.

Refunds

If you request a refund within a billing period during which you have not made any API requests, we will issue a full refund for that period. Refund requests should be sent to info@genderize.io.

Price Changes

Price changes apply only to new subscriptions. If you have an active subscription, your price will not change for as long as your subscription remains active and uninterrupted. If you cancel and later resubscribe, the current pricing at the time of resubscription applies.

4. Permitted Use

You are expressly permitted — and expected — to access the Services through automated means, including scripts, applications, bots, API clients, SDKs, third-party integrations, and workflow automation tools. This is how the Services are designed to be used.

You may use the Services for any lawful commercial or non-commercial purpose, including but not limited to:

  • Enriching customer databases and CRM systems
  • Academic and scientific research
  • Content personalization and audience analysis
  • Fraud detection and identity verification workflows
  • Marketing segmentation and analytics
  • Integration into your own products and services

5. Restrictions

You agree not to:

  • Abuse the infrastructure. Do not attempt to circumvent rate limits, overload the API with excessive requests beyond your plan, or interfere with the operation of the Services.
  • Build a competing service. Do not use the Services or their output to create a product or service that competes with Demografix's APIs — for example, by systematically querying names to build and operate your own name-to-demographics prediction service.
  • Resell raw predictions. Do not resell API results as a standalone dataset. You may, however, incorporate predictions into your own products, services, reports, and research. The distinction: our data may be an ingredient in what you build, but it may not be the product you sell.
  • Reverse-engineer the data. Do not attempt to extract, reconstruct, or reverse-engineer the underlying datasets or models.
  • Discriminate. Do not use predictions to unlawfully discriminate against individuals on the basis of gender, age, nationality, or ethnicity. You are responsible for ensuring your use complies with applicable anti-discrimination laws in your jurisdiction.
  • Misrepresent predictions as facts. Do not present API results as verified demographic data about specific individuals. Results are statistical estimates.

6. Caching

You may cache API responses locally. This is encouraged where it reduces redundant requests for the same input.

Note that our underlying data is updated over time as new demographic information is incorporated. Cached results may become outdated. We recommend refreshing cached data periodically, but we do not impose a specific time limit.

7. Intellectual Property

Demografix owns all rights in the Services, including the APIs, the underlying datasets, the statistical models, and all associated documentation and content.

You own the data you submit to the Services (the names you query). You retain all rights to your input data.

API responses are licensed to you for use in accordance with your subscription and these Terms. This license is non-exclusive, worldwide, and valid for as long as your subscription is active. Cached results may continue to be used after your subscription ends, subject to the restrictions in Section 5.

8. Availability and Support

We aim to keep the Services available and performant, but we do not guarantee uninterrupted access. The Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We do not currently offer a formal Service Level Agreement (SLA). If this changes, it will be communicated on our website.

Support is provided via email at info@genderize.io on a reasonable-efforts basis.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Demografix's total liability arising from or related to these Terms or your use of the Services is limited to the amount you paid to Demografix in the twelve (12) months preceding the event giving rise to the claim.
  • Demografix is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, regardless of whether we were advised of the possibility of such damages.

These limitations do not apply to liability that cannot be excluded or limited under applicable law, including liability under mandatory consumer protection provisions in your jurisdiction.

10. Indemnification

You agree to indemnify and hold harmless Demografix from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Services in violation of these Terms
  • Your use of API predictions in a manner that violates applicable law, including anti-discrimination laws
  • Any dispute between you and a third party related to your use of API results

11. Suspension and Termination

By You

You may cancel your subscription and close your account at any time.

By Us

We may suspend or terminate your access to the Services if:

  • Your payment method repeatedly fails and is not resolved within the retry period (typically three weeks)
  • You engage in activity that materially violates these Terms, including infrastructure abuse or building a competing service
  • Your use of the Services creates legal exposure for Demografix — for example, using predictions for unlawful discrimination in a manner that could implicate us

Where practicable, we will notify you before taking action and give you an opportunity to remedy the issue. In cases of serious or ongoing abuse, we may act immediately.

Effect of Termination

Upon termination, your access to the Services is revoked. You are not entitled to a refund of unused subscription time, except as described in Section 3 (Refunds). Cached API results may continue to be used in accordance with Section 6 and subject to the restrictions in Section 5.

12. Data and Privacy

Demografix processes names submitted via the API to generate predictions. For individual API requests, names are processed in real time and are not stored after a response is returned.

For CSV file uploads, the original file is processed in memory and not written to disk. The processed results file is stored temporarily and is deleted after you download it or after 24 hours, whichever comes first.

We do not log the names you submit or the IP addresses of API requests.

In the event of an application error, our error monitoring service (Sentry) may transiently capture request data as part of an error trace. This data is used solely for debugging.

API request metadata (such as request counts and API key usage) is logged for rate limiting and billing purposes.

Your account information (email, subscription details) is stored for the duration of your account.

Payment information is handled by Stripe. Card details never reach Demografix's servers.

13. Third-Party Services

The Services rely on the following third-party providers:

  • Stripe (payment processing) — San Francisco, CA, USA
  • DigitalOcean (infrastructure) — New York, NY, USA
  • Sentry (error monitoring) — San Francisco, CA, USA

These providers may process limited data in connection with the Services. Both DigitalOcean and Sentry participate in the EU-US Data Privacy Framework. Stripe is certified under the EU-US Data Privacy Framework and uses Standard Contractual Clauses where applicable.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email at the address associated with your account at least 30 days before the changes take effect.

Your continued use of the Services after the effective date of updated Terms constitutes acceptance. If you do not agree with the changes, you may cancel your subscription before they take effect.

15. Governing Law and Disputes

These Terms are governed by the laws of Denmark, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising from these Terms shall be submitted to the courts of Denmark.

If you are a consumer habitually resident in the European Union, you retain the benefit of any mandatory consumer protection provisions of your country of residence.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and any Data Processing Agreement entered into between you and Demografix, constitute the entire agreement between you and Demografix regarding the Services.
